1. Acceptance of Terms

By accessing the website located at https://alcattest.ca (“Website”) and using any related services provided by Inspired Life Health Centre Inc. (“Inspired Life”, “we”, “our”, “us”), you agree to abide by these Terms of Service (“Terms”) and comply with all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using this Website or any other services provided by Inspired Life.

We reserve the right to review and amend any of these Terms at our sole discretion. Changes to these Terms will take effect immediately upon publication on this page. These Terms were last updated on March 8, 2025.

2. Description of Services

“Inspired Life” offers the “Alcat Test in Canada” service, where clients can purchase the Alcat food sensitivity testing kits. We facilitate the purchase, delivery, and processing of the Alcat test, in collaboration with Cell Science Systems, which performs the analysis of blood samples sent to their laboratory in the United States.

Important: Inspired Life Health Centre Inc. does not conduct the laboratory testing or analysis. Test results are provided by Cell Science Systems and delivered to clients in a PDF format. We are not responsible for the accuracy, interpretation, or medical implications of these test results.

3. Shipping and Handling of Test Kits

• Clients will receive the Alcat test kit directly from Inspired Life.

• Clients must arrange for their blood to be drawn at an authorized blood draw facility.

• The blood draw must occur only between Monday and Wednesday to ensure timely delivery to Cell Science Systems.

• The test kit includes a prepaid packaging and shipping waybill. The blood draw facility is responsible for packaging and shipping the blood sample to Cell Science Systems using the provided materials.

• Inspired Life is not liable for delays, lost packages, or any mishandling of samples once the kit is in transit to Cell Science Systems.

4. Client Responsibilities

By purchasing and using the Alcat test, you agree to:

• Follow all instructions provided with the test kit carefully.

• Ensure your blood draw is performed at a qualified facility between Monday and Wednesday only.

• Understand that Inspired Life is not responsible for the actions or fees of third-party blood draw facilities.

• Provide accurate and complete information as required for processing the test and delivering results.

5. Medical Disclaimer

The Alcat test is intended to identify potential food sensitivities and intolerances. However, it is not a substitute for professional medical advice, diagnosis, or treatment. Clients should consult with a healthcare professional before making any changes to their diet, lifestyle, or medical regimen based on Alcat test results.

6. Limitations of Liability

• The Website and all services are provided on an “as is” and “as available” basis. Inspired Life disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• Inspired Life shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website, test kits, or reliance on test results.

• Inspired Life is not responsible for any medical or health outcomes resulting from the use of the Alcat test.

7. Refunds and Cancellations

• All Sales Are Final: Due to the nature of the Alcat test and the handling of medical testing kits, all purchases are non-refundable. Once a test kit has been purchased, no refunds will be issued under any circumstances.

• No Cancellations: Once an order is placed and payment is received, cancellations are not permitted.

• Client Responsibility: It is the client's responsibility to ensure proper use of the test kit, adherence to the blood draw schedule (Monday to Wednesday), and completion of the shipping process to Cell Science Systems using the provided prepaid packaging and shipping waybill.

8. Data Privacy

• All personal and health information collected is handled in accordance with our Privacy Policy.

• By purchasing and using the Alcat test, you consent to your information being shared with Cell Science Systems for the purpose of test analysis and result delivery.

• Inspired Life is not responsible for how Cell Science Systems handles your data, and you are encouraged to review their privacy policies directly.

9. Right to Refuse Service

Inspired Life reserves the right to refuse service to anyone for any reason, including but not limited to violations of these Terms or misuse of our services.

10. Indemnification

You agree to indemnify and hold harmless Inspired Life Health Centre Inc., its affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Website or services.

• Any health-related actions taken based on Alcat test results.

• Any breach of these Terms by you.

11. Dispute Resolution and Governing Law

• These Terms are governed by and construed in accordance with the laws of Ontario, Canada.

• Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts of Ontario, Canada.

• Clients acknowledge that any disputes related to the laboratory testing process itself may also be subject to the jurisdiction and laws of the United States, where Cell Science Systems is located.

12. Changes to These Terms

Inspired Life reserves the right to update or modify these Terms at any time. We will notify users of significant changes through the Website or via email if applicable.
